Article 7: Discipline |
Section 1: |
Any member who commits any act which is not in the best interests of the Chapter or in any way reflects conduct not becoming of a member, may be suspended or expelled, as provided in the Constitution and By-Laws of the International Fraternity.

Section 2: |
Any member of Delta Upsilon who shall create a disturbance, shall be fined by the Executive Board, and such fines shall include the cost of any repair to damaged property. Fines shall not exceed ten dollars above the cost of any property damage. Also brotherly privileges will be revoked for a probationary period determined by the Executive Board. The following actions shall be considered as creating a disturbance:

Paragraph 1: |
Damage to the house or its contents.

Paragraph 2: |
Unnecessary noise in the house, if continued after warning by any member.
|
Paragraph 3: |
Violation of a provision of an officer's policy.
|
Paragraph 4: |
Disorderly Conduct during chapter meetings.
|
Paragraph 5: |
Violation of Culver-Stockton College policy.
|
Section 3: |
If a member becomes lax in paying bills, the executive board may start the process of probation, suspension, and possible expulsion as described in Article VII, Section 7.

Section 4: |
If a member falls below required semester or cumulative GPA, the Judicial Review Board may start the process of probation, suspension, and possible expulsion as described in Article VII, Section 7.

Section 5: |
If a member feels that any officer is not fulfilling the requirements of his office, he may refer charges before the Brotherhood. A two-thirds vote is required to remove an officer. An officer must be given every opportunity to attend the meeting at which this trial is to occur.

Section 6: |
The Judicial Review Board may instate upon any member fines, probation, or suspension following a hearing as stated in Section 8, Paragraph 4. Probation consists of the loss of any office held, and loss of all voting rights. Suspension consists of the loss of all fraternity function privileges in addition to penalties imposed by probation. If further actions are warranted, a member may have charges set forth upon them as described in Article VII, Section 8, Paragraph 5.

Section 7: |
The Judicial board of the Chapter shall be as follows:

Paragraph 1: |
Membership shall consist of the President, presiding officer in all cases except financial and scholarship; the Treasurer, presiding officer in all financial cases; the Vice President for Scholarship, presiding officer in all academic cases. The alumni president or an appointee from the alumni chapter; to act as an advisee with no voting privileges. Four members at large, one from each class. The member will remain on Judicial Review Board until they are elected to an Executive office, are no longer in good standing with the house, graduate, or choose to step down. The President will appoint to fill the vacancies and a 2/3 vote of the house is needed to approve the appointment. The Judicial Review Board members must maintain the same academic standards as stated in Article VI, Section 7.

Paragraph 2: |
The presiding officer is the only person who may call a meeting. All members of the board shall be given 24 hour notice of a meeting. Five of the six members must be present to constitute a quorum. An academic advisor will be given the opportunity to attend scholarship issues, such as an alumni advisor will be for judicial and financial issues. The presiding officer does not vote, except in the event of a tie. Each brother may have his choice of a public or private meeting.

Paragraph 3: |
The Judicial board will handle all cases of charges against brothers.

Paragraph 4: |
In the event the board member is the subject in question, the board will operate with five members. Presidential reappointment will be needed if more than one board member is involved. In the event that the President is involved, the house will delegate, by a majority vote, a member to serve on the board temporarily. The Treasurer will fill in for the President’s absence. If the Treasurer is involved in a financial case, or the Vice President for Scholarship is involved in a Scholarship case, the President will act as the presiding officer.

Section 8: |
Brotherhood Charges:

Paragraph 1: |
Charges must be filed with the President. There is then a minimum of a seven-day waiting period before the trial.

Paragraph 2: |
Charges are heard at this first meeting with the Judicial Review Board. After the case is presented and questions are answered the board will go into executive session. They will then decide if the brother is guilty or not guilty of the said charges.

Paragraph 3: |
There is a 48-hour waiting period before the Judicial Review Board reconvenes to decide the sanctions.

Paragraph 4: |
Appeals must be written and given to the President within 48 hours of the meeting. In the case of an appeal on guilty charges, the case goes in front of the chapter. If the house overrides the Judicial Review Board’s decision the charges are dropped. If the house agrees with the decision the Sanction hearing will take place. If an appeal is written for the sanctions, they go in front of the house. If the house overrides the Judicial Review Board’s decision with a majority vote, the Judicial Review Board will reconvene to find alternate sanctions.

Paragraph 5: |
A member will have an option to appeal to the Executive Board if they so specify in their letter of appeal. They may appeal for charges, and for sanctions. Executive Board trials will happen between Judicial Review Board trial and house trial if it is requested by the member.
